This property is part of the Jack H and Sue Ann Pack estate. Jack and Sue were active in Mercer county education and sports for many decades. Jack served as the head football coach at Princeton High School as well as assisting with sports programs at Bluefield and Pikeview. Sue was a national and world champion powerlifter. This property has been their family home since 1977 and Sue lived in the house until last year. In 2013 they established a separately deeded small private family cemetery on the property (0.06 Acres) along with a perpetual right of way for access to the cemetery. This cemetery will not convey and remains the property of the Pack family heirs. 

           

The centerpiece of this property is the imposing two story Colonial style farmhouse with impressive columned front porch. This historic home was constructed in 1881 with later additions at both ends of the house. Local legend says that this was the first house in Mercer County WV to have indoor plumbing. There is a large primary bedroom downstairs with its own ensuite full bathroom. Upstairs are 3 or 4 bedrooms depending on how you count along with a half bath. Please note that there is no heating and cooling to the upstairs except what comes up from the downstairs from registers and the stairway. On one side of the kitchen you will find a half bath and a shower room on the other side. The house has been upgraded with vinyl siding, replacement windows, two mini split HVAC systems, propane hot water baseboard heat etc. but there is significant foundation settling that has occurred over the years. The roof was last replaced 15-20 years ago and could use some attention with some shingles blowing off in a recent windstorm. Beyond the house you will find a number of outbuildings, large open backyard, a small field, and over 100 acres of forested land stretching along Willowton Road. There are mountain streams on three sides of the property and the East River flows along the northern boundary for about 1,300 ft.  A spring fed pond is on the property as well as a waterfall where one of the streams drops into the East River. It should be noted that there is a steep bluff along the river with no easy access from the property to the river except for at the road. The upside is that almost none of this property is in a flood plain. There are some interior trails and some possible cabin or homebuilding sites that could be developed. The timber has not been cut for at least 30-40 years and mature hardwoods predominate. You will find whitetail deer, black bear, wild turkey and plenty of other critters that call this property home. The upper edge of the property is about 250 ft from the entrance to the Tate Lohr Wildlife Management Area.

There has not been a survey done on the property but using GIS lines we calculate there to be approximately 115 acres. The metes and bounds description in the deed calls for 169 acres but we do not believe that is correct. There is a small 1/3 acre tract in a separate tax map parcel that is being sold with this property but the 0.06 acre private family cemetery does not convey.

This auction is conducted by Mountain Valley Auction Group LLC and Twin City Auction Company (Auctioneer) on behalf of the owners of the property referred to as the (Seller). Auctioneer is not responsible for the acts of the Seller or statements made by the Seller before, during, or after the auction. The auction shall be governed by the terms set forth herein and any announcements made at the auction. The act of submitting a bid shall constitute Bidder’s acceptance of each and every term and condition contained in these terms and conditions and shall form a binding contract of intent to purchase between the Bidder and the Auctioneer. All persons attending the auction and inspecting the property assume all risks whatsoever of damage or loss to person and property and specifically release the Auctioneer from all liability. PAYMENT TERMS:
A signed contract and a nonrefundable deposit of $15,000 is required from the high bidder(s) immediately after confirmation of final bid and the balance due at closing within or  about 30 days (unless prior arrangements have been made with the auctioneer). Deposit must be in the form of a wire transfer or check drawn on a US bank. The signed contract and non-refundable deposit is due within 24 hours of the auction ending unless other arrangements have been made with Auctioneer prior to the close of the auction. BIDDING:
Using YOUR knowledge and experience, form your own opinion of the property and bid accordingly. If you are in doubt, DO NOT BID. The property is sold AS-IS; this is an AUCTION and all SALES ARE FINAL. Bids cannot be retracted and are binding contracts between Bidder and Auctioneer/Seller. The identity of all bidders will be verified prior to participation. The Auctioneer may require a proof of funds letter be submitted prior to bidder participation. A credit card is required to register for online bidding. No charges will be made to your card unless you are determined to be the winning bidder and you fail to execute the Contract of Sale and pay the required earnest money deposit. At the discretion of the Auctioneer, a penalty of $1,000.00 will be charged to the credit card provided at registration if you fail to return the signed Contract of Sale and pay the required earnest money deposit within the required time period. Payment of the penalty shall not affect other remedies available to the Seller for such failure.

BROKER COMPENSATION:
Preapproved (No later than 5:00 PM the day before the auction ends) brokers participation will be compensated. Twenty percent (20%) of the buyers premium will be paid to a qualified licensed real estate agent whose registered buyer's offer is accepted by the seller and closes on the property. To qualify for a commission, the agent must first register his/her self and client with the Auctioneer at least 24 hours prior to the close of auction. Brokers only receive commission when they represent a client, not if they themselves are the client. Commissions will be paid only after closing and after the Auctioneer has been paid in full. Agents are not required to attend the closing but must attend the auction with their client and/or visit the property with their client during the marketing period. Agents must have client's permission to register him/her for the auction. Agents may not register people who are not actually their clients. If an agent has not met all of these requirements, no commission will be paid to the cooperating agent, even if the agent's client purchases the property. Under no circumstances whatsoever will any commission be paid if the sale does not close for any reason.
